Rules - Loëla Parrainage 2021 Contest

ARTICLE 1 – ORGANIZATION OF THE GAME

FEVA, a simplified joint-stock company with a single partner (SASU) with a capital of 20,000 euros, whose registered office is at 14 rue Alexander Taylor in Pau (64000), registered with the R.C.S de Pau under number 829 326 172 (hereinafter the "Organizing Company" and represented by Valentin VILLA in his capacity as President).

Organizes from 08/18/2021 to 08/31/2021 (inclusive), a free game without obligation to purchase entitled: "Sponsorship 2021 Contest" according to the terms described in these rules and accessible on the page available at the following URL: https://www.loela.fr/pages/fidelite

This operation is neither organized nor sponsored by Facebook, Instagram, Google, Twitter, Apple or Microsoft.

The personal data collected in the context of this Game is intended for the organizing company and not for Facebook, Instagram, Google, Twitter, Apple or Microsoft.

ARTICLE 2 – CONDITIONS OF PARTICIPATION

This Free Game is open to any natural person of legal age, with internet access and a valid email address, and residing in the following countries: Metropolitan France / Overseas France / Worldwide, with the exception of the personnel of the organizing company and their families, as well as all persons having participated in the development of the Game.

The mere fact of participating in this Game implies the pure and simple acceptance, without reservation, of these rules.

ARTICLE 3 – TERMS OF PARTICIPATION

This Game is a sponsorship operation consisting of sending a referral link to a friend via e-mail so that he or she can register for the Loëla loyalty program as a godson during the dates indicated in article 1 .

Participation in the Game is as follows:

- Person must sign up or be signed up for our loyalty program

- The person must send their referral link to one or more people of their choice, who are not yet registered in the Loëla loyalty program.

- If the sponsored person registers for the Loëla loyalty program during the dates indicated in article 1, then the sponsor and his godson participate in the draw for the Game.

Only one entry per sponsor/godchild couple (same surnames, same first names, same e-mail addresses) is authorized during the entire period of the Game and only one winner per household will be accepted (same postal address)

The personal data collected during the Game is intended for the organizing company in accordance with article 12 of these rules.

The Game being accessible on a mobile phone (Smartphone), under no circumstances will Apple, Microsoft, Google or any other mobile application platform be held responsible in the event of a dispute related to the Game.

ARTICLE 4 – DESIGNATION OF WINNERS

A godfather/godson couple will be randomly chosen on Wednesday, September 1st among players who meet the conditions of participation.

Gift vouchers will be awarded as follows:

- A gift voucher worth 100 Euros (one hundred euros) for the referrer

- A gift voucher worth 100 Euros (one hundred euros) for his godchild

Each winner will be contacted directly by email, by the Company within 7 days after the completion of the draw to inform him and send him his prize.

ARTICLE 5 – AWARD

The prizes to be won are:

- A gift voucher of €100 (one hundred euros) for the godfather and a gift voucher of €100 (one hundred euros) for his godchild, valid until October 31, 2021, to choose from on the online store https://wwwloela.fr/ or at the Loëla boutique, 14 rue Alexander Taylor in Pau (64000).

The organizing company reserves the right to verify the age of any winner before handing over the gift vouchers. Under no circumstances may the prizes be exchanged for their cash value or for any other prize.

The organizing company cannot be held responsible for the use or non-use, or even trading, of the gift vouchers by the winners.

In the event of force majeure, the organizing company reserves the right to cancel the prize(s) won without consideration.

ARTICLE 6 – IDENTIFICATION OF WINNERS AND ELIMINATION FROM ENTRY

Entrants authorize the verification of their identity and all information provided during their participation.

Contacts communicated with incomplete or false contact details will not be taken into consideration and will result in the elimination of participation.

Similarly, non-compliance with these rules as well as any fraud or attempted cheating, regardless of its terms, will lead to the pure and simple elimination of the author's participation.

ARTICLE 7 – MODIFICATION OF GAME DATES AND EXPANSION OF THE NUMBER OF PRIZES

The organizing company cannot incur any liability in the event of force majeure or events beyond its control if it were to cancel this Competition. It also reserves the right to extend or limit the period of participation, to postpone it or to modify the conditions, its responsibility cannot be engaged as a result.

Additions and modifications to these rules may be published during the Game. They will be considered as annexes to these rules. Any change will be subject to prior information by any appropriate means.

ARTICLE 8 – USE OF THE IDENTITY OF WINNERS

Your personal data is processed by the organizing company, acting as recipient and data controller, in accordance with applicable European and French data protection regulations.

By participating in our game, you consent to our processing and collection of your personal data. The personal data collected is mandatory. If you do not provide the required data, you will not be able to participate in the game. Your data may be used for commercial prospecting purposes, subject to your agreement.

Your personal data is transferred to our marketing and communication department, as well as to service providers and subcontractors to whom the organizing company may call for the needs of the organization and/or management of the game.

These subcontractors are located in the European Union.

You can withdraw your consent at any time.

You have rights of access, rectification, deletion and portability of your data, limitation and opposition to the processing of your data as well as the right to define directives relating to the fate of your personal data after your death.

ARTICLE 9 – REIMBURSEMENT OF PARTICIPATION FEES

Given that in the current state of service offers and technology, most mobile and Internet access providers offer a free or flat-rate connection to their users, it is expressly agreed that any access to the site being carried out on a free or flat-rate basis cannot give rise to any reimbursement, insofar as the subscription to the services of the mobile access provider and to the Internet is in this case contracted by the user for his use in general and that the fact that the participant connects to the site and participates in the Game does not incur any additional costs or disbursements.

ARTICLE 10 - RESPONSIBILITIES

Participation implies knowledge and acceptance of the characteristics and limits of the Internet, the lack of protection of certain data against possible misappropriation or piracy and risks of contamination by possible viruses circulating on the network. The organizing company declines all direct or indirect responsibility in the event of misuse or incident related to the use of the computer, access to the Internet, maintenance or malfunction of the Game servers, or any other technical connection, sending forms to an incorrect or incomplete address.

It is up to all participants to take all appropriate measures to protect their own data and/or software stored on their computer equipment against any attack.

The organizing company will make its best efforts to allow access to the Game. The organizing company may, at any time, in particular for technical reasons, updates, maintenance, interrupt access to the site and to the Game. The organizing company will in no way be responsible for these interruptions and their consequences. No compensation can be claimed in this respect.

In addition, the organizing company cannot be held liable in the event of delivery problems or loss of e-mail (in particular with regard to the delivery of prizes). Any prize sent by the organizing company to a winner that would be unclaimed or unused would be lost for the winner and would remain acquired by the organizing company. The organizing company cannot be held responsible for the malfunctioning of the Internet network.

ARTICLE 11 – INTELLECTUAL, LITERARY AND ARTISTIC PROPERTY RIGHTS

The images used on the Game site, the objects represented, the trademarks and commercial names mentioned, the graphic and computer elements and the databases making up the Game site are the exclusive property of their respective owners and cannot be extracted, reproduced or used without the written authorization of the latter, under penalty of civil and/or criminal prosecution.

ARTICLE 12 – PERSONAL DATA

The organizing company implements computer processing for the purpose of managing the Game. The organizing company is responsible for the processing of personal data that may be collected.

The personal data collected will be used solely for the organization of the Game. If the participant has chosen to do so by ticking the corresponding box after registering, his email address will be used to send him the newsletter.

Participants are informed that by accessing the Game's website, a cookie may, if necessary, be stored on the hard drive of their computer. This is a small computer file used to record their navigation on the website of the Game. Cookies are used to identify each participant in order to allow him to access information more quickly, avoiding him to re-enter it. They can in no way damage the data present in his computer.

A participant can object to the registration of this cookie. When this setting is made, the participant nevertheless retains the possibility of accessing the Game's website and participating in it.

In accordance with the "Informatique et Libertés" law of January 6, 1978 as amended and European Regulation 2016/679 of April 27, 2016 relating to the protection of individuals with regard to the processing of personal data, you have a right of access and rectification to information concerning you as well as a right of opposition, the right to limit processing and erasure within the framework permitted by the European Regulation.

The participant can access the information concerning him by sending an email to the address: aide@loela.fr .

If he considers, after contacting the Company, that his IT rights and Freedoms are not respected, he can send a complaint to the CNIL.

ARTICLE 13 – ATTRIBUTION OF JURISDICTION AND INTERPRETATION OF THE RULES

Any possible dispute on the interpretation of the rules will be settled by the organizing company.

Participation in this Game implies the unreserved acceptance of (i) these rules in all their stipulations, (ii) the ethical rules in force on the Internet (netiquette, charter of good conduct, etc.) as well as ( iii) the laws and regulations in force on French territory and in particular the provisions applicable to games and lotteries in force. No telephone or written request concerning the interpretation or application of these rules, the mechanisms or methods of the Game or the list of winners will be answered. In the event of a dispute, only a registered letter with acknowledgment of receipt sent within a maximum period of 30 days after the end date of the Game will be admissible. Except in the event of manifest errors, it is agreed that the information resulting from the systems of Game of the organizing company have probative force in any dispute regarding the connection elements and the computer processing of said information relating to the Game.

Prior to any legal action related to or in connection with these rules (in particular its application or interpretation), participants undertake to file an amicable and free appeal with the organizing company.

Participants are subject to French regulations applicable to games and competitions.

Any dispute that cannot be settled amicably will be submitted to the competent courts on which the head office of the organizing company depends, unless otherwise provided by public order.
